Carlisle man faces 200-plus charges

Suspicion of theft of Arkansas Scholarship Lottery tickets has led to 207 charges of lottery fraud against a Carlisle man.

The charges were among those filed in January, in Lonoke County Circuit Court, by prosecuting attorney Chuck Graham.

Kevin Phillips, 42, was named in the lottery fraud charges. Richard Jason Wargo, 40, Cabot, was the first case filed in circuit court for 2014.

According to the arrest affidavit, on April 2, 2012, Robert Allison, owner of the Phillips 66 store at Carlisle, filed a report at the Carlisle Police Department of suspicion that an employee had stolen Arkansas Scholarship Lottery tickets.

Allison reported that the suspected thefts were discovered through bookkeeping, and that records showed the instances occurred when Kevin Phillips was working. He also reported that Phillips was the only employee with the code to activate the ticket bundles.

Allison said that, in each instance, entire bundles of lottery tickets were activated, all the tickets scanned and winning tickets cashed within “just a few minutes.”

Time sheets showed that Phillips’ work hours during February and March 2012 were when the Arkansas Scholarship Lottery Retailer Instant Ticket Validations showed the bundles of lottery tickets being activated, tickets scanned and the winning tickets cashed.

The affidavit listed store records that showed 12 instances, between Feb. 11 and March 22, 2012, of one to five ticket bundles being activated and tickets scanned in this manner.

Allison said the tickets were not bought. A daily list showed a total of 28 bundles were activated and scanned in this manner; each bundle cost $300 for a total cost of $8,400, as well as 179 winning tickets cashed for a payout of $3,140.

When each of the bundles was activated and scanned, Phillips was the only employee working and was the only employee with the activation code. After each bundle was activated, the tickets in the bundles were all scanned “within just a few minutes.”

Allison and an Arkansas Scholarship Lottery investigator told Carlisle investigators that such ticket sales is not common and not consistent with typical lottery ticket sales at the Carlisle store or other businesses selling lottery tickets.
