Former Ward officer takes plea agreement

In a plea agreement filed July 8, 2013, in Lonoke County Circuit Court, a former Ward police officer was found guilty of a misdemeanor charge of theft of property.

In the agreement, Carolyn Michele Scroggins, 42, of Cabot, pleaded no-contest to a reduced misdemeanor charge of theft of property. Circuit Judge Sandy Huckabee made the guilty finding, and approved the sentence of 12 months supervised probation and a $500 fine plus court costs, as well as a no-contact order with the victim. The sentence was levied under “Act 531,” the Community Punishment Act of 1993.

Scroggins was a Ward police officer at the time of the investigation.

Scroggins originally faced felony theft of property in a charge filed June 12, 2012 by special prosecutor Cody Hiland. The charge was based on information filed by state police investigator Doug Moss with prosecuting attorney Chuck Graham; Graham asked that a special prosecutor be assigned to the action.

In the complaint, Scroggins was accused of taking jewelry from family member Angela Scroggins and pawning the jewelry for about $1,300.

Carolyn Scroggins said that she had pawned the jewelry but had done so only at the request of Angela Scroggins, which Angela Scroggins denied.

Under Act 531, individuals who are placed on probation or given a transfer sentence to the Department of Community Correction for certain offenses may have the charges dismissed after successfully serving their sentence.

Anyone whose record is expunged under Act 531, “shall have all privileges and rights restored, shall be completely exonerated, and the record which has been expunged shall not affect any of his civil rights or liberties, unless otherwise specifically provided for by law.”

Individuals also can say they have no prior conviction — the offense “shall be deemed as a matter of law never to have occurred, and the individual may state that no such conduct ever occurred and that no such records exist.” However, although the record is sealed, it will not be destroyed and remains available to law enforcement officials under certain conditions.
